Abstract


In Romania, international private law relations are regulated by the Law no. 105/1992. The above-mentioned law provides the rules to determine the applicable law in cases of juridical relations containing a foreign element, as well as the procedural norms in litigations concerning relations of international private law. The provisions of this law are general and, if the international conventions which Romania has adhered to, do not set a different approach, they are to be enforced in relations with any state, not only the member states. During the negotiations for adhering to the EU, our country assumed the task of completing and modernizing the national legislative framework and has transposed the Council’s Regulation no. 44/2001 – concerning the jurisdictional competence, the acknowledgment and execution of rulings, in civil and commercial matters, passed in the member states – in the Law no. 187/2003. The law is applicable only until 1 January 2007 when Romania is to adhere to the EU.
