Abstract

In the paper we have examined the constitutive elements of the offense of extortion under the Romanian law and the elements of similarity and difference in relation to the previous law.

The conducted examination includes references to jurisprudence adopted by the courts in Romania and some views on the application of more favorable criminal law, with some elements of differentiation between the previous and the current regulation. The innovative elements of this paper is both the examination and the considerations relating to the application of more favorable criminal law in transitional situations. The paper can be useful to students of faculties and law enforcement practitioners.
