Principes de l’interprétation Juridique

Ioan Huma

Abstract

This paper distinguishes between the general principles of law and the principles of judicial interpretation, approaching the statute of the later ones. It is pointed out that, the principles
of the judicial interpretation, although immanently having an axiological foundation ensured by the general principles of law, operate with another register, being functionally formed and orienting the interpretation towards the context from the technical and methodological point of view, in the same
time having an applicative pattern.
