Abstract

Representing an absolute novelty in the Romanian legislation within the paper it was examined the institution of renouncing to applying the penalty in the context of the provisions of the New Criminal Code, of implementing and changing the law. We are also presenting some critical comments and suggestions of lege ferenda, the work can be useful both for academic theorists and practitioners and also for the legislator with the entry into force of the New Criminal Code. The innovations presented in this study regard the legal text analysis and the critical remarks.
