Abstract

Constitutional traditions of the Member States are an important element in the construction of a European Administrative Law. Various principles can be deduced from the Treaty establishing a Constitution for Europe as constituting general principles of administrative action in Europe. In the same time, the Constitution recalls the dissimilarities existing in the Member States between legislative and implementing (or executing) functions. The Treaty establishing a Constitution for Europe stipulates some principles that are applicable for administrative action. In most cases these principles are addressed to the Union Institutions, in others they are directly applicable in Member States’ action.
